The safety of our guests is our highest priority.

Weather-related cancellations are determined solely by the Captain.

Conditions that may require cancellation include, but are not limited to:

• Lightning
• Severe thunderstorms
• Small Craft Advisories
• Gale Warnings
• Dangerous wind or sea conditions
• Dense fog
• Other conditions deemed unsafe by the Captain

The following do not qualify as weather cancellations:

• Forecasted rain
• Isolated showers
• Overcast skies
• Cooler temperatures
• Customer preference not to travel due to weather forecasts

If Beach Charters By The Bay cancels due to unsafe weather, guests may choose either:

• A full refund, or
• Rescheduling to a mutually available date.

FULL REFUNDS ON DEPOSITS ARE GIVEN IF CANCELLATION NO LESS THAN 72 HOURS FROM DEPARTURE TIME. NO REFUNDS PROVIDED WHEN TWO OR MORE CAPTAINS ARE REQUESTED FOR A MULTI BOAT CHARTER, REGARDLESS OF THE TIME.

Approved refunds will be returned to the original payment method whenever possible.

Depending upon your financial institution, refunds may require 5–10 business days to appear.

Credit card processing fees or third-party booking platform fees may be deducted where applicable.

Fishing and watersports are not offered at this time. 

The legal limit is 6 passengers. This is set by the United States Coast Guard and is regulated regularly in Tampa Bay. 

“National Operator of Uninspected Passenger Vessel (OUPV) of Less Than 100 GRT

This officer endorsement is most appropriate for uninspected passenger vessels which by law are limited to six or less passengers for hire. These are usually smaller vessels and normally engage in charter fishing, whale watching, SCUBA diving, and tour cruises.”

Beach Charters By The Bay, LLC follows Federal and State laws. Additionally, we do not allow smoking or glass bottles on the vessel, and have the right to terminate a charter without refund if passengers are belligerent, destructive, or engaging in any other acts the Captain deems inappropriate or unsafe.
